But brake overrides are a new thing, and have never been required by law. So it might be similar to a situation where a car is not equipped with an airbag, resulting in death. <br /><br />I believe that you cannot and should not punish a carmaker for not being the first to come out with a newly invented safety feature. Even after a new safety feature becomes mandated by law, older cars never are required to be retrofitted.<br /><br />Besides, this brake override is not even needed by anyone who knows to hold down the "engine off" button for three seconds. Or who knows how to use the brakes, or knows how to shift into neutral .... But Toyota has been very reluctant to insult the drivers.
